Declaration of Compliance in the food industry

As a company working in the food industry, you need a Declaration of compliance for each step of the production and delivery chains. This Declaration of compliance conditions are especially strict when ruling goods and materials in contact with food. Plastic materials are especially targeted with this document, because of the higher risk of material impact on the food product itself. The Declaration of compliance for plastic materials and articles intended to come into contact with food serves as guarantee for the documentation transparency but also as protection for the product safety and quality.

Basic principles:

The Commission regulation (EC)  No 10/2011 on plastic materials and articles intended to come into contact with food (also known as Plastics Implementation Measure or PIM) serves here as legal reference. The regulation sums up and harmonizes the previous directives such as the Commission Directive 2002/72/EC. The regulation deals with the manipulation of plastic materials and articles intended to come into contact with food and broaden the standing orders to the raw materials.

The general specification required for the plastic material intended to come into contact with food in the regulation 1935/2004. Under the article 3, it is specified that all materials “shall be manufactured in compliance with good manufacturing practice” to guarantee the product safety and integrity.

The Declaration of Compliance for plastic materials and articles shall contain the following information:

All of these information are requested by the regulation (EC) 2007/19 Annex VII and VIa:

  1. Identity and adress of the manufacturer or importer of the plastic materials
  2. Identity of the materials
  3. Date of the declaration
  4. Confirmation that the materials meet the relevant requirements of the regulations (EC) No 1935/2004 and No 10/2011
  5. Information relative to the materials and their restrictions and/or specifications
  6. Information relative to the materials migration test
  7. Specifications on the use of materials
  8. Confirmation that the materials meet the corresponding requirements, when a plastic functional barrier is used in a plastic multi-layer material

Declaration of compliance in other domains:

The Declaration of compliance can also be applied to any product, process or machine. For each Declaration of compliance, different regulation principles will prevail, requiring further documents.

A special form of Declaration of compliance is the EC Declaration of conformity used for example in the machine industry. In this case, the manufacturer would have to guarantee that the product matches the specification required in the EC Machinery directive. To document these requirements, a manual of instruction, a technic documentation and a risk analysis will be necessary. The EC Declaration of conformity must be attached to any delivered product.
